On March 2, 2011, Judge Adler issued his report and recommendation 21 (the "R&R"), recommending that the petition be denied. Objections were due March 25, 22 2011, but Petitioner filed none and did not seek additional time within which to do so. This matter was referred to Magistrate Judge Jan Adler for report and 23 A district court has jurisdiction to review a Magistrate Judge's report and 24 recommendation on dispositive matters. Fed. R. Civ. P. 72(b). "A judge of the court may 25 accept, reject, or modify, in whole or in part, the findings or recommendations made by the 26 magistrate judge." 28 U.S.C. § 636(b)(1). The Court reviews de novo those portions of the 27 R&R to which specific written objection is made. United States v. Reyna-Tapia, 328 F.3d 28 1114, 1121 (9th Cir. 2003) (en banc). "The statute makes it clear that the district judge must -1- 09cv2127 1 review the magistrate judge's findings and recommendations de novo if objection is made, 2 but not otherwise." Id. When no objections are filed, the Court need not review the report 3 and recommendation de novo. Wang v. Masaitis, 416 F.3d 992, 1000 n.13 (9th Cir. 2005). 4 See also Schmidt v. Johnstone, 263 F.
