ORDER Adopting 34 Report and Recommendations of United States Magistrate Judge; And Granting in Part and Denying in Part 18 Motion to Dismiss. All claims in Plaintiff's First Amended Complaint, except his ADA claim against Defendant in their official capacities, are dismissed with prejudice.
