ORDER granting Defendant's 8 Motion to Compel; denying 8 Motion to Dismiss; granting 8 Motion to Stay. Parties are to forthwith to submit to binding arbitration as to Pla's 2nd cause of action for breach of contract. Pla's 1st ca use of action for breach of the implied covenant of good faith and fair dealing is not subject to binding arbitration. Court stays the litigation pending arbitration.
