On November 28, 2011, the Court convened an Early Neutral Evaluation Conference in

the above entitled action. Appearing for Plaintiff were Nancy Dix, Esq., and Brian Behmer, Esq.

18

Appearing for Defendant were Jeff Feasby, Esq., and David Tartaglio, Esq.

19

Settlement could not be reached in the case at this time.

20

The Court discussed compliance with Fed. R. Civ. P. 26 and based thereon, issues the

21

following orders:

The Rule 26(f) conference shall be completed before December 22, 2011;

23

2.

A discovery plan shall be lodged with Magistrate Judge McCurine, Jr. on or

24

before January 9, 2012. Regarding each witness, the discovery plan will include

25

the name, most current address, most current phone number, and a brief

26

description of the subject matter of his/her testimony. The discovery plan will

27

also include the anticipated dates for the completion of both non-expert discovery

28

and expert discovery; and,

The date of initial disclosure pursuant to Rule 26(a)(1)(A-D) shall occur before
January 13, 2012;

Counsel are ordered to appear on January 20, 2012 at 2:00 p.m. in the chambers

of United States Magistrate Judge William McCurine, Jr., 940 Front Street,

5

Courtroom C, San Diego, California, 92101, for a Settlement / Case Management

Conference pursuant to Federal Rule of Civil Procedure 16(b). COUNSEL ARE

ORDERED TO BRING A DRAFT PROPOSAL RE: INJUNCTION FOR

REVIEW AT THE TIME OF THE CONFERENCE.
