On April 18, 2011, Defendant Ferrero U.S.A., Inc. filed a motion to dismiss Plaintiffs’
19 consolidated complaint. (Doc. No. 31.) On May 31, 2011, Plaintiffs filed their response in
20 opposition to Defendant’s motion. (Doc. No. 39.) A hearing on this motion is currently
21 scheduled for June 13, 2011 at 10:30 a.m. On June 1, 2011, the parties filed a joint motion to
22 continue the hearing date and the deadline for Defendant’s reply briefing. (Doc. No. 40.) For
23 good cause shown, the Court GRANTS the joint motion.
The Court, pursuant to its discretion under Local Rule 7.1(d)(1), determines this matter
24
25 is appropriate for resolution without oral argument, submits the motion on the parties’ papers,
26 and vacates the June 13, 2011 hearing. Any reply to the Plaintiffs’ opposition must be filed
