ORDER (1) Adopting 19 Magistrate Judge's Report and Recommendation, (2) Denying 14 Plaintiff's Motion for Summary Judgment and (3) Granting 16 Defendant's Motion for Summary Judgment. This Court, having reviewed de novo the Magis trate Judge's R&R, adopts the Magistrate Judge's recommendation in full and DENIES Plaintiff's motion for summary judgment and GRANTS Defendant's motion for summary judgment. The parties filed cross-motions for summary judgment, and on November 17, 20 2016, Magistrate Judge William V. Gallo issued a Report and Recommendation 21 (“R&R”) recommending that the Court deny Plaintiff’s motion and grant Defendants’ 22 motion. Neither side has filed objections to the R&R, and the time for doing so has 23 expired. 24 This Court, having reviewed de novo the Magistrate Judge’s R&R, adopts the 25 Magistrate Judge’s recommendation in full and DENIES Plaintiff’s motion for 26 / / / 27 / / / 28 / / / -1- 15cv2664 1 summary judgment and GRANTS Defendant’s motion for summary judgment.
