Pending before the Court is a joint motion to dismiss this case with prejudice under
15 Federal Rule of Civil Procedure 41(a)(1)(A)(ii) brought by Plaintiff Payton Moyer and
16 Defendant Tesla Motors, Inc. ([Doc. 11], “Joint Motion”.) Good cause appearing, the
17 Court GRANTS the Joint Motion and ORDERS the case DISMISSED WITH
18 PREJUDICE.

IT IS FURTHER ORDERED that each party shall bear its own fees, expenses,
20 and costs.

IT IS FURTHER ORDERED that Defendant Tesla Motors, Inc.’s pending
22 Motion to Compel Arbitration [Doc. 8] is denied as moot.
