Having reviewed the Stipulation and being otherwise fully advised, the Court hereby orders as follows: 1. All claims asserted in Plaintiff' Amended Complaint and all claims s asserted in Defendants' Counterclaims are hereby DISMISSED WITH PREJUDICE. 2. This Order does not address, dismiss or resolve issues relating to the attorneys' fees and costs that the Court by Order dated January 27, 2006 ordered Defendants to pay to Plaintiff as sanctions for Defendants' failure to comply with the Court' October 11, 2005 Order compelling Defendants to produce certain documents s in discovery. The Court retains jurisdiction over this case and the Parties for the purpose of resolving issues relating to sanctions and determining the amount of attorneys' fees and costs to be paid by Defendants to Plaintiff as sanctions. 4.
