The action had already been removed on February 2, 2007, and given Civil Action No. 07-cv-00246-RPM. Because the Notice of Removal was filed electronically and because the court' electronic case filing s system is incapable of recognizing the obvious and treated the removal as a separate civil action which, by random assignment, went to Judge Marcia Krieger as Civil Action No. 07-cv-00430-MSK, the plaintiff filed a motion to consolidate the two cases on March 8, 2007.
