M i c h a e l Doyle seeks a writ of mandamus granting his 28 U.S.C. § 2254 h a b e a s application now pending before the district court. It is not appropriate to r e q u e s t that this court decide the merits of a habeas case pending before the d i s t r i c t court. While we may issue a writ of mandamus directing a district court t o proceed where the court has unduly delayed in deciding a pending habeas a p p l i c a t i o n , see Johnson v. Rogers, 917 F.2d 1283, 1285 (10th Cir. 1990), a r e v i e w of the district court's docket indicates that the magistrate judge recently i s s u e d a report and recommendation and Mr. Doyle filed objections, so this case i s proceeding toward conclusion in the district court.

T h e petition for a writ of mandamus is DENIED. Because Mr. Doyle has p r e s e n t e d no non-frivolous arguments in support of the writ, his motion to p r o c e e d in forma pauperis is DENIED. Entered for the Court,
