ORDER to Dismiss in Part and Assign Case. Applicant's "Motion to Amend Claims to the Present Writ of Habeas Corpus" filed on 12/12/2008, is GRANTED to the extent Applicant seeks to add a claim that counsel was ineffective for not takin g adequate steps to obtain and bring forth at trial the alternate suspect known as "Sisco" and DENIED to the extent Applicant seeks to add a claim that counsel was ineffective by failing to introduce evidence to the jury of retaliation by Sisco. Claims four, five, seven, and eight in the amended application filed on 11/7/2008, are dismissed as procedurally barred. This case shall be drawn to a district judge and to a magistrate judge by Judge Zita L. Weinshienk on 03/04/2009.(sah, )
