First, the Tenth Circuit Court of Appeals issued its mandate in this case on July 20, 2009 [docket #71]; thus, the appeal is no longer pending. Second, the document appears to be the same motion filed in this matter on May 11, 2009 [docket #49], which was denied by this Court on May 15, 2009 [docket #51].
