As stated during the Scheduling Conference, the Court is considering the motion in a timely manner in accordance with all appropriate laws, rules and regulations. The Court reminds the parties that, if any plaintiff in this matter wishes to raise additional allegations not already contained in a pleading, he may seek to amend the Second Amended Complaint in accordance with federal and local rules, but may not do so in a motion such as the one filed within.
