Thus, Mr. Hendrickson is an unavailable witness pursuant to Fed. R. Civ. P. 32(a)(4)(B) and Fed. R. Evid. 804(b)(1). Although REB Civ. Practice Standard III.F.3. states that " eposition testimony d shall be filed not later than 45 days before trial,"the Fed. R. Civ. P. 30(b)(6) deposition

of ISI was taken on March 12, 20101 and a transcript of the deposition testimony was not received by undersigned counsel until Friday, March 26, 2010.
