ORDER granting in part and denying in part 54 Motion for Order to hold appeal in abeyance, the Court's order dismiss the case (doc#46) is vacated, with respect to Plaintiff's motion to hold the appeal in abeyance (doc#54) to the extent Pl aintiff asks the Court to reconsider its denial of Plaintiff's motion for reconsideration, the motion is granted, it is otherwise denied and the Court's order denying Plainitff's motion for lack of jurisdiction (doc #52) is vacated and Plaintiff's motion for reconsideration (doc#47) is denied on the merits, the case is dismissed without prejudice by Judge Christine M.
