ORDER to Dismiss in Part and to Draw Case to A District Judge and to a Magistrate Judge. Defendant Aristedes Zavaras, Defendant Foster, and Defendant Kevin Milyard are dismissed as parties to this action. Plaintiff has failed to allege facts to show that Defendants Zavaras, Foster, and Milyard personally participated in the alleged violations of Plaintiff's constitutional rights and has asserted facts against Defendants Foster and Milyard that do not support an arguable claim for relief. T he Fourteenth Amendment equal protection claims is dismissed because the facts asserted by Plaintiff do not support an arguable claim for relief.
