This matter is before the Court on Plaintiffs’ Motion for Leave to File Surreply to
Rule 12 Motions to Dismiss [Docket No. 195; Filed August 5, 2011] (the “Motion”). On
August 8, 2011, the Court issued a Report and Recommendation [Docket No. 198]
regarding disposition of Defendants’ Motions to Dismiss [Docket Nos. 128, 135, 137, 141
& 142]. Accordingly,
IT IS HEREBY ORDERED that the Motion is DENIED as moot.
IT IS FURTHER ORDERED that Plaintiffs’ proposed Surreply [Docket No. 197] is
STRICKEN.
