ORDER ENTERED BY SENIOR JUDGE LEWIS T. BABCOCK
Plaintiff’s “Petition for Federal Injunction Pursuant to Fed. R. Civ. P. 65” (ECF No.
39) and Plaintiff’s “Motion to Set Hearing” (ECF No. 40) are DENIED because the
instant action was dismissed by order filed on September 5, 2012. Furthermore, the
Court lacks jurisdiction to consider the motions because Plaintiff has appealed to the
United States Court of Appeals for the Tenth Circuit.
