Amended Motion to Strike Defendant& #039;s Second Supplemental Fed.R.Civ.P 26(a)(2)(B) Non-Retained Expert Witness Disclosures & to Quash Subpoenas to Related Individuals 75 is DENIED, for reasons stated on record. The currently scheduled depositions of Mr. Albrecht, Mr. Gallardo, and Mr. Erickson shall proceed as noticed by the Defendant on January 5, 2015 with Mr. Wollenweber defending. To the extent Plaintiff wishes to obtain deposition testimony from any of the three witnesses related to qualifications pursuant to Fed. R. Evid. 702, Plaintiff may notice and take one further deposition of each witness at his expense within the extended discovery period. At Plaintiff's expense in this context means that the Plaintiff shall notice the deposition(s) and pay normal expenses of taking such a deposition.
