IT IS HEREBY ORDERED that Defendant’s Motion for Summary Judgment [#52],
Plaintiff’s Cross-Motion for Summary Judgement [sic] [#57], and Plaintiff’s Motion for CrossSummary Judgement [sic] [#68] are DENIED as moot.
