Mr. Vasquez is not present for the beginning of today’s hearing as the prison did not have it 
scheduled for him to call in.  Ms. Owen has entered a limited appearance for purposes of the 
motions discussed in today’s hearing.  This hearing comes before the Court in regards to 
MOTION [16] for Preliminary Injunction, MOTION [26] to Dismiss and MOTION [28] to Dismiss 
From Defendants Gabel Chamjock and Keri McKay.

Mr. Vasquez is transferred into the courtroom. 

ORDERED:  MOTION [26] to Dismiss and MOTION [28] to Dismiss From Defendants Gabel 
Chamjock and Keri McKay are GRANTED without prejudice from the bench.  Mr. 
Vasquez may file a motion for leave file a second amended complaint with a
