The matter is before the court on the Notice of Dismissal Without Prejudice as to Defendant Roy Eckert Pursuant to F.R.C.P. 41 or, in The Alternative, F.R.C.P. 15 [#30]1 filed September 11, 2014. After reviewing the notice and the record, the court has concluded that the notice should be approved, and that plaintiff’s claims against defendant, Roy Eckert, should be dismissed without prejudice. THEREFORE, IT IS ORDERED as follows: 1. That the Notice of Dismissal Without Prejudice as to Defendant Roy Eckert Pursuant to F.R.C.P. 41 or, in The Alternative, F.R.C.P. 15 [#30] filed 1 “[#30]” is an example of the convention I use to identify the docket number assigned to a specific paper by the court’s case management and electronic case filing system (CM/ECF). I use this convention throughout this order. September 11, 2014, is APPROVED; 2. That plaintiff’s claims defendant, Roy Eckert, are DISMISSED WITHOUT PREJUDICE; and 3.
