MOTION FOR APPROVAL OF STIPULATION The parties to this action, by their undersigned counsel, hereby request that the Court approve their Stipulation set forth below concerning the schedule for briefing Plaintiffs' pending motion for attorney fees and costs. STIPULATION WHEREAS, on December 9, 2009, Plaintiffs filed their First Amended Complaint, setting forth five claims; WHEREAS, the Court agreed to sever and try independently Plaintiffs' first claim, that Defendant discriminates on the basis of sex in the allocation of athletic participation opportunities; WHEREAS, the Court tried that claim in a bench trial from June 21, 2010 to June 25, 2010;

WHEREAS, the Court issued a decision on July 21, 2010, finding in favor of Plaintiffs on their first claim for relief; WHEREAS, Plaintiffs' other claims have not yet been resolved; WHEREAS, Plaintiffs filed a motion for award of attorneys' fees and costs on August 4, 2010; and WHEREAS, the parties have agreed that the Court may defer consideration of Plaintiffs' application for attorneys' fees; NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED by and between the undersigned attorneys for Plaintiffs and Defendant, that: 1. Plaintiffs shall submit additional documents in support of their

motion for attorneys' fees and costs by October 1, 2010; 2. Defendant shall submit its opposition to Plaintiffs' motion for

attorneys' fees by November 1, 2010; 3. Court. This schedule is subject to modification by further order of the
