IS

HEREBY GIVEN pursuant to Federal Rule of Civil Procedure 30 that

Defendant and Counterclaimant Facebook, Inc. (“Facebook”) will the take deposition upon oral
examination of Ladenburg Thalmann & Co., Inc. on February 10, 2010, at 9:00 am at 1020
Biscayne Building, 19 West Flagler Street, Suite 1020, Miami, FL 33130, and continuing from
day to day thereafter until completed.

The deposition will be recorded by a certified

stenographic reporter. Facebook may also record the deposition by videotape and through the
