HEREBY GIVEN pursuant to Federal Rule of Civil Procedure 30 that

Defendant and Counterclaimant Facebook, Inc. (“Facebook”) will the take deposition upon oral
examination of David Scott Ehlers on June 8, 2010, at 9:30 a.m.,1 at Hyatt on Capitol Square, 75
East State Street, Columbus, OH and continuing from day to day thereafter until completed. The
deposition will be recorded by a certified stenographic reporter. Facebook may also record the
