STIPULATION AND [PROPOSED] ORDER WHEREAS Plaintiff Market America, Inc. filed this action on July 7, 2009; WHEREAS Plaintiff Market America, Inc. filed an Amended Complaint on September 30, 2009; WHEREAS the Court granted Defendants' motions to dismiss Counts I, II, and III of the Amended Complaint on August 9, 2010; WHEREAS according to Rule 12, Defendants' answers to the remaining Count IV of the Amended Complaint would ordinarily be due by August 23, 2010; and WHEREAS to allow sufficient time for communication between counsel and clients, for investigation of the facts and law, and because of prearranged vacation schedules, the parties have agreed on a schedule and respectfully request the Court's permission to extend the defendants' response date by 30 days; IT IS HEREBY STIPULATED AND AGREED by and among the parties, subject to the approval of the Court, that defendants Google Inc. and LTech Consulting, LLC will answer Count IV of Plaintiff Market America's Amended Complaint on or before September 22, 2010.
