Dear Judge Stark:
Pursuant to this Court's November 25, 2013 Oral Order (D.I. 543), Google elects to
proceed with a liability only trial beginning on March 10, 2014, as currently scheduled. In light
of the prejudice to Google associated with proceeding on this trial date (see D.I. 538, 542),
Google again respectfully requests that, if a date in May 2014—the date jointly proposed by the
parties on September 30, 2013 (D.I. 529)—becomes available on the Court's calendar, the Court
consider rescheduling the trial for that date.
