MOTION FOR JUDGMENT AS A MATTER OF LAW ON
THE INFRINGEMENT AND VALIDITY OF THE PATENTS-IN-SUIT AND ON
GOOGLE’S BREACH OF CONTRACT COUNTERCLAIM
Pursuant to Federal Rule of Civil Procedure 50(a), and in furtherance of the stipulation
that the parties may amplify their oral motions for judgment as a matter of law in writing within
three days (D.I. 645), Plaintiff-Counterclaim Defendant Personalized User Model, L.L.P.
(“PUM”) and Counterclaim-Defendant Dr. Yochai Konig hereby move for judgment as a matter
of law in their favor on the infringement and validity of the patents-in-suit and on Google’s
breach of contract counterclaim.

The grounds for this motion are set forth in PUM and

Dr. Konig’s oral arguments to the Court on March 18, 2014, and in their opening brief
elaborating on those arguments, filed herewith. A proposed form of order is attached.
