ORDER
At Wilmington this 23rd day of December 2011:
Having reviewed the parties’ letters on how this case should proceed (D.I. 296, 297), and
having heard further from the parties on this matter by teleconference held this date,
IT IS HEREBY ORDERED that:
1.
The trial scheduled to begin on February 14, 2012 is CANCELLED.
2.
All dates in the governing Scheduling Order are VACATED.
3.
The case is STAYED for all purposes other than those listed below in paragraph 4
and alternative dispute resolution.
4.
The parties are directed to meet and confer and submit for the Court’s
consideration, no later than December 30, 2011, a schedule whereby:
a)
New York will file and the parties will brief a motion to dismiss;
b)
Intel will file and the parties will brief a motion requesting that the Court
exercise supplemental jurisdiction, pursuant to 28 U.S.C. § 1367, in the
event that all federal claims are dismissed with prejudice; and
c)
briefing is completed on Intel’s Supplemental Motion for Summary
Judgment (D.I. 293).
