STIPULATION AND ORDER FOR DISMISSAL
Plaintiff and Counterclaim-Defendant Xerox Corporation, and Defendant and
Counterclaim-Plaintiff Yahoo! Inc., hereby stipulate by and through their respective
attorneys that, pursuant to Rules 41(a) and 41(c) of the Federal Rules of Civil Procedure,
all claims against Yahoo! in the above-entitled action are dismissed with prejudice and
Yahoo!'s counterclaims are dismissed with prejudice subject to the parties' understanding
and agreement that such withdrawal and dismissal shall not preclude Yahoo! from
asserting in the future the same or similar counterclaims and related defenses against
anyone who in the future alleges infringement by Yahoo! of the Patent in suit in this
matter, without costs or attorneys' fees to either party.
