MEMORANDUM AND SERVICE ORDER. All claims against the defendants George Lancaster and Warden Perry Phelps, and the deprivation of personal property claim against Matthew K. McMullen are dismissed as frivolous. The court has identified what appears t o be a cognizable excessive force claim against the defendant Matthew K. McMullen and he will be allowed to proceed against this defendant. The plaintiff shall return to the Clerk original USM 285 form(s).
