MEMORANDUM ORDER: A review of Plaintiff's "amendment" and "supplement" reveal that they do not contain common questions of law and fact as to all defendants. Accordingly, the Court will strike the "amendment" and su pplement" (D.I. 21 , 22 ). Plaintiff has the option of commencing a new action raising these claims should he wish to do so. The instant case will proceed on the operative pleading at D.I. 1 and 17 . Defendant's replies in support of their motions to dismiss are due on October 12 (see D.I. 32 ). Signed by Judge Leonard P.
