Respondents designate the entire return (aside, of course, from information that is marked as classified and to be treated as such and aside from information contained in the declassified return that Respondents publicly filed on September 9, 2009 (dkt. No. 18)) as "Protected Information" pursuant to the Protective Order of September 11, 2008. Respondents filed a Notice of Filing of Factual Return for ISN 934 on August 7, 2009 (dkt. No. 12). However, this notice inadvertently included Respondent's Statement of Legal Justification which had previously been filed on the same day (dkt.
