No. 08-442 (TFH) GUANTANAMO BAY ) DETAINEE LITIGATION ) ) _______________________________________) NOTICE OF FILING UNDER SEAL PLEASE TAKE NOTICE THAT Respondents are filing this day under seal, in connection with the Motion by Press Intervenors for an Order To Show Cause Why the Government Should Not Be Held in Contempt (Dkt. No. 1868), a Notice of Supplemental Authority bringing to the Court's attention the recent decision by the D.C. Circuit in Ameziane v. Obama, No. 09-5236 (D.C. Cir. Jan. 8, 2010). The Court of Appeals' decision is relevant to the issues presented by the Press Intervenors' motion. Respondents' Notice of Supplemental Authority must be filed under seal because the Court of Appeals issued its decision in Ameziane under seal, owing to the protected information identified in the body of the Court's opinion. Respondents have prepared a redacted version of the opinion that they consider suitable for public release, but the Clerk of the Court of Appeals has advised Respondents that prior to releasing the opinion they must file for the Court of Appeals' consideration a motion to unseal the redacted opinion. Respondents will prepare and file such a motion forthwith.
