JOINT STATUS REPORT Pursuant to the Court's Minute Order of September 8, 2009, the undersigned parties respectfully submit this joint status report: 1. Since the last status report, Plaintiff Whitman Insurance Company, Ltd. and

Defendant Pneumo Abex LLC ("Pneumo Abex") have continued to engage in mediation efforts with participating defendants. 2. David Geronemus continues to oversee the mediation. Since the last status report,

Plaintiff and Pneumo Abex and the London Market Companies completed a final settlement and this Court entered an Order approving the dismissal with prejudice of the certain defined London Market Companies on October 7, 2009. 3. Following the mediation session earlier this summer, First State Insurance

Company continues to work on a subsequent presentation of its evaluation of the data provided by or on behalf of Pneumo Abex. 4. Plaintiff and Mt. McKinley Insurance Company anticipate further settlement

discussions in the coming weeks.

the process of responding to these requests. 7. In sum, the parties continue to believe that settlement efforts to date have been

helpful. To provide sufficient additional time for settlement efforts to be successful, the parties request that the time for parties to re-file any of the motions withdrawn and for any Defendant to answer or otherwise respond to the Amended Complaint be extended to and including February 1, 2010, with another status report provided on December 30, 2009.
