Under Paragraphs 4(v) and 5(a)(5) of the Consent Decree, EPA was required to establish pH and organics total maximum daily loads ("TMDLs") for the Middle Potomac River by September 30, 2007, if EPA has not approved TMDLs submitted by the District by that date. On September 24th, 2007, the parties agreed to further modify Paragraph 5(a)(5) of the Consent Decree to require EPA to establish the organics TMDL on or before October 31, 2007 and the pH TMDL on or before November 30, 2007, as detailed in the attached September 2007 modification.
