DEPARTMENT OF JUSTICE, Defendant. ) ) ) ) ) ) ) ) ) ) ) Civil Action No. 11-1080 (ABJ) ECF DEFENDANT’S SCHEDULING REPORT Defendant, United States Department of Justice (“DOJ”), by and through its undersigned counsel, hereby responds to the Court’s Order dated August 15, 2011 and provides a scheduling report in this action which arises under the Freedom of Information Act (“FOIA”), 5 U.S.C. § 552, as amended. Specifically, Defendant reports that two DOJ component have potentially responsive documents and are in the process of preparing Vaughn declarations to support an anticipated motion for summary judgment. The two components – the DOJ Criminal Division (“CRM”) and the Executive Office of United States Attorneys, which was referred records by DOJ CRM – anticipate that the declarations and any additional disclosures will be completed within the next three weeks. Defendant will notify the Court on or before October 3, 2011 if the Vaughn declarations have been completed. Defendant will also confer with Plaintiff with respect to a briefing schedule.
