ORDER, For the reasons set forth in the Memorandum Opinion entered this 26th day of September 2012, it is hereby ORDERED that plaintiff's Motion for Appointment of Counsel Pursuant to 17 U.S.C. 3006A 13 is DENIED; it is further ORDERED that De fendants Warden Simon T. Wainwright and Warden Isaac Johnson's Motion for Additional Time to FIle a Response to the Complaint 28 are GRANTED nunc pro tunc; it is further ORDERED that Warden Simon T. Wainwright's Motion to Dismiss or in t he Alternative For Summary Judgment 19 is GRANTED; it is further ORDERED that Defendant Isaac Johnson's Motion to Dismiss 22 is GRANTED; it is further ORDERED that Defendant's Motion to Dismiss 29 is GRANTED; and it is further ORDERED that plaintiff's complaint is DISMISSED as to all defendants.
