UNITED STATES DISTRICT COURT FOR THE DISTRICT OF COLUMBIA __________________________________ ) FOX TELEVISION STATIONS, INC., ) et al., ) ) Plaintiffs, ) ) v. ) Civil Action No. 13-758 (RMC) ) FILMON X LLC, et al., ) ) Defendants. ) _________________________________ ) ORDER Upon consideration of the parties’ Joint Motion to Stay the Litigation Pending Appeal, Dkt. 50, and good cause appearing therefor, it is hereby ORDERED that the parties’ Joint Motion to Stay the Litigation Pending Appeal, Dkt. 50, is GRANTED; and it is FURTHER ORDERED that the Preliminary Injunction, Dkt. 34, REMAINS IN EFFECT and is not stayed; and it is FURTHER ORDERED as follows: 1. The litigation will be stayed until the United States Court of Appeals for the District of Columbia Circuit has ruled on Defendants’ appeals from the September 5, 2013 Preliminary Injunction and September 12, 2013 denial of motion for reconsideration; 2. Neither party may argue that staying the litigation has any effect on the issue of irreparable harm; 3. The stay does not preclude any party from bringing to this Court’s attention any changes in the pertinent law; 1 4. The stay does not preclude the Court from modifying the scope of the injunctive relief granted pursuant to the Preliminary Injunction; 5. The stay does not preclude Plaintiffs from enforcing the Preliminary Injunction or from seeking relief for any new infringements by Defendants that are not the subject of the Preliminary Injunction; and 6. The parties shall file a joint status report no later than fourteen days after issuance of a decision by the D.C.
