LODGING OF THE CLASSIFIED DECLARATION BY THE ACTING DEPUTY
DIRECTOR OF THE NATIONAL SECURITY AGENCY
FOR REVIEW IN CAMERA AND EX PARTE
Defendant United States Department of Justice (“DOJ”) hereby provides notice that the
classified declaration of Frances J. Fleisch, Acting Deputy Director of the National Security
Agency (NSA), was lodged with the United States Department of Justice Litigation Security
Group for secure storage and can be made available to the Court by a Classified Information
Security Officer for the Court’s in camera, ex parte review. This declaration relates to
Defendant DOJ’s Motion to Dismiss, or, In the Alternative, For Summary Judgment Regarding,
Plaintiffs’ Claims Against the Verizon Defendants. An unclassified declaration by the Acting
Deputy Director of the NSA will be filed on the public record as an exhibit to the motion.
