In the United States Court of Federal Claims No. 10-743C Filed: September 9, 2011 ******************************************* * * GOOGLE, INC., * * and * * ONIX NETWORKING CORPORATION, * * * Plaintiff, * * v. * * THE UNITED STATES, * * Defendant, * * and * * SOFTCHOICE CORPORATION, * * Defendant-Intervenor. * * ******************************************* * ORDER The preliminary injunction issued by the court on January 3, 2011, as renewed on July 2, 2011 and August 31, 2011, and modified on September 7, 2011, will remain in effect until September 19, 2011. The purpose of this extension is to allow the parties to prepare a proposed order regarding the terms of the appointment of an independent technical expert, pursuant to Fed. R. Evid. 706(a), who will supplement the Administrative Record with a report to the court and parties. By September 19, 2011, the parties shall submit a proposed order reflecting the agreement, discussed with the court on September 8, 2011, pursuant to which Plaintiff, Google, Inc., will submit to the Department of the Interior (“DOI”) its full certification and accreditation package and DOI will engage an independent technical expert(s) who will make a report to DOI that DOI will evaluate and decide upon for the court’s consideration.
