ORDER
The Government’s March 4, 2011 Motion To Terminate The Stay Of Proceedings is
granted in part. The Court’s January 3, 2011 Remand to the Department of the Interior and Stay
of Proceedings is terminated. The Preliminary Injunction entered on January 3, 2011 will remain
in place and is not affected in any way by this order. The parties are directed to file a proposed
scheduling order on or before Thursday, May 5, 2011.
In addition, Softchoice’s March 15, 2011 Motion to Re-file Previously Dismissed Filings
is granted. Accordingly, Softchoice’s November 19, 2010 Motion to Dismiss, December 17,
2010 Reply Memorandum in Support of its Motion to Dismiss, and December 17, 2010
Opposition to Plaintiffs’ Motion For Judgment On The Administrative Record and Cross-Motion
for Judgment on the Administrative Record, are deemed re-filed.
