UNITED STATES DISTRICT COURT
MIDDLE DISTRICT OF FLORIDA
ORLANDO DIVISION
PATRICK COYNE, JESSLYN COYNE, RYAN COYNE AND JE MCFARLAND, INC., Plaintiffs, -vsDUDLEY E. GARNER, SUSAN GARNER, DUDLEY AND SUSAN GARNER TRUST, DENNIS BASILE, Receiver, AND JOHN DOE,, Defendants. ______________________________________ Case No. 6:04-cv-1202-Orl-31KRS
ORDER
On October 8, 2004, Magistrate Judge Spaulding issued a Report (Doc. 20) recommending that Plaintiffs' Motion to Proceed in forma pauperis (Doc. 7) be Denied. No objections were filed by Plaintiffs and on November 2, 2004, the Court confirmed the Report and Recommendation and denied the Plaintiffs' Motion (Doc. 32). That Order required Plaintiffs to pay the filing fee within 11 days, and advised Plaintiffs that failure to do so will result in a dismissal of this case without further notice. On November 17, 2004, Plaintiffs filed a Motion (Doc. 43) which, among other things, requests reconsideration of the Order denying Plaintiffs' application to proceed without payment of fees. Plaintiffs' Motion is both untimely and without merit. Accordingly, it is ORDERED that Plaintiffs' Motion is DENIED. Plaintiffs shall pay the filing fee by December 3, 2004. Failure to comply with this Order will result in the dismissal of this action
