OPINION AND ORDER re: terminating as moot 25 Amended MOTION for partial summary judgment, granting 35 MOTION to dismiss Amended Complaint, granting 56 MOTION to dismiss Amended Complaint [Doc. 2]. Plaintiff's Complaint is d ismissed as time barred against the aforementioned Defendants. The Clerk is directed to remand the case to the Circuit Court of the Second Judicial Circuit, in and for Charlotte County, Florida, and to transmit a certified copy of this Order to the Clerk of that Court.
