ORDER
This cause comes before the Court on the Application to Proceed in District Court Without
Prepaying Fees and Costs (Doc. No. 2) filed December 2, 2011.
On December 14, 2011, the United States Magistrate Judge issued a report (Doc. No. 5)
recommending that the complaint be dismissed and that the application be denied. No objections
have been filed. Therefore, it is ORDERED as follows:

The Report and Recommendation is ADOPTED and CONFIRMED as part of this
