ORDER
This cause comes before the Court upon the Report and Recommendation filed by
Magistrate Judge Thomas B. Smith on June 3, 2014 (Doc. 4). In the Report and Recommendation,
Magistrate Judge Smith recommends that the Court dismiss, without prejudice, Plaintiff's
complaint and that Plaintiff be given leave to file an amended complaint within twenty-one (21)
days. Judge Smith further recommends that Plaintiff's Motion to Proceed In Forma Pauperis be
carried until Plaintiff has had an opportunity to amend her complaint.
All parties were furnished copies of the Report and Recommendation and were afforded
the opportunity to file objections pursuant to 28 U.S.C. § 636(b)(1). No such objections were filed.
Upon consideration of the Report and Recommendation, and upon this Court's independent
examination of the file, it is determined that the Report and Recommendation should be adopted.
The Court agrees with the Magistrate Judge that Plaintiff has failed to establish subject matter
jurisdiction and failed to sufficiently plead a cause of action. Accordingly, it is now
ORDERED AND ADJUDGED:

The Report and Recommendation of the Magistrate Judge (Doc. 4) is adopted,
confirmed, and approved in all respects and is made a part of this Order for all

the Report and Recommendation.
