ORDER adopting and approving 81 Report and Recommendation. Defendant's Motion for Order to Show Cause 72 is granted in part and denied in part. Plaintiff Rahmatullah Mayan's Second Amended Complaint 21 is dismissed without preju dice. Plaintiff Rahmatullah Mayan's Answer to the Counterclaim 52 is stricken and the Clerk of Court is directed to enter default against Plaintiff Rahmatullah Mayan. Defendants are awarded $1,995.00 in attorneys' fees and $75 .00 for the court reporter fee, pursuant to Rule 37. Defendants' Counterclaim and Third-Party Complaint 32 are dismissed without prejudice to their timely re-filing in state court. The Clerk of Court is directed to close the file.
