Wiand, as Receiver (the "Receiver"), respectfully moves the Court for an order setting a status conference to update the Court on the present posture of this Receivership, including the claims process, clawback and other lawsuits, and the status of the Receivership's current assets. The Receiver was appointed on January 21, 2009 (Doc. 8), and although he has filed six (6) interim reports which include significant detail about the Receiver's efforts and this Receivership, he believes it would of benefit to hold a status Case No. 8:09-cv-87-T-26TBM

conference so that he can provide to the Court an in-person status report with the participation of the Securities and Exchange Commission. WHEREFORE, the Receiver respectfully moves the Court to set a status conference at the Court's convenience. LOCAL RULE 3.01(g) CERTIFICATE OF COUNSEL The undersigned counsel for the Receiver is authorized to represent to the Court that the Securities and Exchange Commission has no objection to the Court's granting this motion.
