NOTICE OF COMPLIANCE WITH ORDER REGARDING RESPIRO, INC.
On September 7, 2012, Burton W. Wiand, as Receiver (the “Receiver”), filed his
Motion to Expand the Scope of Receivership to Include Respiro, Inc. (Doc. 904), along with
his declaration in support of the motion (Doc. 905) and the declaration of Christopher Moody
(Doc. 906). That same day, all three documents were sent via U.S. Mail and email to
William Kalish, counsel for Respiro, Inc. On September 10, 2012, the Court entered an
Order (Doc. 907) inter alia directing the Receiver to immediately notify Mr. Kalish of the
entry of the Order.

This notice is being filed to inform the Court that the Receiver has complied with the
Order. On September 10, 2012, counsel for the Receiver emailed the Order to Mr. Kalish
and also sent a copy of the Order (along with a second copy of the motion and supporting
documents) to Mr. Kalish by U.S. Mail.
