ORDER: Defendant Sunjoy Industries Group, Inc.'s Motion for Summary Judgment 34 , and Defendants' Dispositive Joint Motion for Summary Judgment 37 are GRANTED. Plaintiffs' Motion to Establish Rebuttal [sic] Presumption of Negligen ce 38 and Plaintiffs' Motion to Dismiss All Claims against Defendant Sunjoy Industries, Group, Inc. without Prejudice 40 are DENIED. Defendants' Motion to Dismiss based on Plaintiffs' Fraud on the Court 35 is DENIED AS MOOT. Pl aintiffs' Motion to Compel Discovery 49 is DENIED AS MOOT. The CLERK is directed to enter final summary judgment in favor of Defendants and against Plaintiffs. The CLERK is directed to close this case and terminate any pending motions as moot.
